Motion to dismiss Big Ben lawsuit denied

September 30, 2009

CARSON CITY, Nev. (AP)—A Nevada judge denied motions by lawyers forPittsburgh Steelers quarterback Ben Roethlisberger(notes) to dismiss a civil lawsuitalleging he raped a Lake Tahoe casino worker, according to court documentsreleased Wednesday.

Washoe District Judge Brent Adams rejected arguments that the suit should bedismissed, saying the woman’s allegations make a “sufficient” claim that ifproven, would entitle her to relief.

“The court recognizes that a motion to dismiss is only proper where itappears beyond doubt that the plaintiff could prove no set of facts which, iftrue, would entitle them to relief,” Adams wrote in the order filed lateTuesday.

Adams also refused to strike the woman’s complaint, finding that as written,it is not “unnecessarily salacious or graphic,” as argued by Roethlisberger’slawyers.

In other brief orders, the judge also rejected arguments that the suitshould be dismissed because it failed to name an “indispensable party”—thatbeing Harrah’s Hotel-Casino—and denied Roethlisberger’s request to expeditediscovery, or the sharing of evidence.

Roethlisberger’s lawyer David Cornwell said that despite the outcome, histeam was encouraged by the judge’s reasoning.

“Finding that plaintiff survived this round because of a generous ‘beyonddoubt’ standard indicates that, at these early stages, the court is inclined togive plaintiff her day in court,” Cornwell said in a written statement. “Ofcourse, this cuts both ways.

“In any event, her allegations remain false and we remain committed to avigorous defense.”

Cal Dunlap, the woman’s lawyer, has repeatedly declined comment on courtfilings and did so on Wednesday. The Associated Press, as a matter of policy, does not identify people who say they have been sexually assaulted.

The woman, a 31-year-old VIP hostess at Harrah’s, filed a civil suit inJuly, alleging Roethlisberger sexually assaulted her while he was at Lake Tahoethe previous summer to compete in a celebrity golf tournament. The suit claimedshe was hospitalized for several months because she was traumatized after thealleged attack.

The woman’s suit seeks a minimum $440,000 in damages from Roethlisberger, unspecified punitive damages and at least $50,000 in damages from eight Harrah’sofficials she accuses of orchestrating a cover-up of the incident.

In a separate order, the judge dismissed a claim of trespass against formerHarrah’s employee Stacy Dingman, identified in the woman’s suit as once beingher best friend.

Adams said a more definitive statement is needed for the woman to pursueconspiracy allegations against Dingman, but he left intact other claims ofintentional infliction of emotional distress, invasion of privacy, defamationand punitive damages.

She came fairly close to winning last week. Ochoa, who had won 21 times from2006-08, finished four strokes behind winner Sophie Gustafson at theCVS/pharmacy LPGA Challenge in Danville, Calif.

Recent rains have changed the dynamics some in Prattville.

“I think I have a good plan on how to play the course,” Ochoa said. “It’splaying a little bit longer because obviously it’s a little bit wet and therough is a little bit higher. So I think it should be a little bit differentthan last year.

“But at the same time, a good challenge. I’m happy to be back, and I’mgoing to do my best to defend my title. It would be great to win on Sunday.”

Gustafson, No. 3 money winner Cristie Kerr, Hjorth and Michelle Wie are alsoin the field. It’s a chance for Kerr to make up some ground on Jiyai Shin, wholeads her in the Rolex Player of the Year chase.

Wie returns from a short break for the start of classes at Stanford, where’sshe’s taking communications and statistics courses.

She has six Top 10 finishes in 16 events, including a runner-up at theseason-opening SBS Open at Turtle Bay.

“I had a good two weeks off and a good week of school last week,” Wiesaid. “I’m excited to play again. I felt like I practiced a lot last week andit will be fun to put that into action.”

This is the 19-year-old’s first time playing in the Navistar Classic and herfirst visit to Alabama. She likes the Southern flavor just fine so far.

“I love the food here, love the music. It’s great,” Wie said. “Everyother radio station here plays country music, so I’m pretty happy about that.”

She’d be even happier with her first LPGA victory.

“That’s a goal I can’t really control as much,” Wie said. “More of apersonal goal is what I’ve been trying to accomplish all year: Try my hardestand play my hardest and end the week, knowing I’ve done that.”

DIVOTS: The LPGA announced an extension to hold the Navistar event next yearon Wednesday. … Susann Petterson withdrew from the field for the secondstraight week. … The tour takes a three-week break after the tournament.

Harden hurt again in Thunder practice

September 30, 2009

OKLAHOMA CITY (AP)—Oklahoma City Thunder rookie James Harden’s(notes) first trainingcamp is off to a rough start.

The No. 3 overall pick in this year’s draft got poked in the eye on hisfirst day of training camp. On Wednesday, he had to leave practice again afterrolling his ankle.

“Those things happen when you play hard and compete. That’s the game,”coach Scott Brooks said. “You can’t go a game or a season without being nickedup sometime. Hopefully he gets his out of the way early.”

Brooks said Harden’s injury isn’t severe. The Thunder have opened trainingcamp with back-to-back sessions of two-a-day practices.

Brooks also held center Nenad Krstic(notes) out of practice to let him rest afterplaying this summer for the Serbian national team. Serbia made it to the finalsof the European basketball championship before losing to Spain only 10 days ago.

“He’s in great shape,” Brooks said. “We’re just going to be careful withhis minutes.”

“We definitely need some reps, but we’re going to monitor them in practiceand in games,” he added. “(For the season opener), we want him ready and freshand full strength, and he will be. He’s been around the game a lot of years andhe knows how to get his body ready.”

Forward Nick Collison(notes) sat out for a second straight day with a sprainedankle and is considered day to day. Brooks said Collison was walking betterWednesday, but it’s still too early to tell if he’ll miss Oklahoma City’spreseason opener at Memphis on Oct. 7.

“He’s a winning basketball player and I understand what he does for ourteam,” Brooks said. “He creates a lot of situations that help us win games. Heknows his role as well as anybody on our team, but you’d like to have him out.He would like to be out there.”

Mike Harris(notes) became the fourth non-roster invitee to training camp, joiningRyan Bowen(notes), Tre Kelley(notes) and Michael Ruffin(notes).

Watson, Funk head field in Senior Players tourney

September 30, 2009

TIMONIUM, Md. (AP)—Even if Tom Watson won the British Open, it’s hard toimagine his life would be much better than it is right now.

Watson skipped the past couple weeks on the Champions Tour to work on aninstructional DVD and book. Sales should be rather brisk because of hisperformance last July at Turnberry, when he came tantalizingly close to becomingthe oldest player to win a major on the U.S. PGA Tour.

“This DVD was planned in March of this year. It didn’t have anything to dowith the British,” Watson said Wednesday before quickly adding, “Oh, by theway, it will help. The timing is pretty darn good.”

Now 60, Watson still gets a thrill out of playing in major tournaments. He’ssure to be a crowd favorite at the Senior Players Championship, which startsThursday and runs through Sunday at the Baltimore Country Club.

“This is a favorite course of mine,” said Watson, who finished second herein 2007. He didn’t participate last year because he was getting lefthip-replacement surgery, an operation that changed his way of life.

“I rode a horse at a parade last Saturday,” he said. “Last year, Icouldn’t spread my legs wide enough to get on the back of a horse. Now, man, Ican ride a fat horse, no problem. That’s the difference between this year andlast year.”

That is not the only difference. Even though he lost a playoff to StewartCink in the British Open, Watson has been the recipient of an outpouring of lovefrom around the world.

“The response has been humbling, it’s been overwhelming. It’s a responsethat I would have never foreseen for a guy finishing second in a golftournament,” he said. “The theme has been, ‘You’ve given me hope. You’ve givenme a second charge in my life. You’re 60 years old and still doing this? Maybe Ican still do what I thought I couldn’t do anymore.’ It’s kind of the wonderfultheme that’s come out of this thing.”

Fred Funk, one-third of a stellar threesome with Watson and Nick Price onThursday, won’t soon forget Watson’s unexpected brush with history.

“Almost everyone wanted Tom to win that thing, and he did everything hecould,” Funk said. “Had he won, that would have been one of the greatest, ifnot the greatest, sports accomplishments ever.”

This tournament, the fifth major on the Champions Tour, could come down toduel between Funk and Watson. Funk has finished in the Top 5 in each of theprevious four majors this year, and Watson has three top-10 finishes in thoseevents.

Funk is the Tour leader in Schwab Cup points and finished third and secondin the past two years at this course. But he has been struggling lately, in partbecause he’s trying to recover from a staph infection in his knee.

He paid to have his teacher come in from Wisconsin to help him perfect hisswing.

“Last week, I don’t know what it was, but my whole game just went in thetoilet,” said Funk, referring to his 18th-place finish in the SAS Championship.“I’m a little concerned about where I am right now, and I want to get itfixed.”

Perhaps he can have a revelation similar to the one Watson experienced 15years ago.

“I learned how to swing the golf club on the practice tee at Hilton Head at3:15 in the afternoon after a practice round at the 1994 Heritage GolfClassic,” Watson said. “I made that change, and the golf swing got easy forme.”

Funk grew up in Maryland and coached at the University of Maryland in the1980s, so winning here is clearly a priority.

“This is big. Not only the significance it has for the Schwab Cup andhaving a major under your belt, but it’s my home state,” he said. “I get somuch support here, I would love to put something of this much significance on myresume.”

He expects his threesome to draw the biggest gallery—by far.

“That’s a pretty strong group right there,” he said. “Whoever’s here isprobably going to be following our group. Hopefully I play well.”

The tournament is sponsored by Constellation Energy.

Knicks’ D’Antoni says he’ll stay patient

September 30, 2009

SARATOGA SPRINGS, N.Y. (AP)—Mike D’Antoni could be forgiven if he sometimescatches himself daydreaming of Steve Nash(notes) and Amare Stoudemire executing theperfect pick-and-roll.

Perhaps he occasionally closes his eyes and pictures LeBron James(notes) or someother superstar finishing on the fast break.

When he opens them again, he sees a New York Knicks team that is givenlittle chance of winning big this season.

Yet D’Antoni vows to stay patient and positive, even if he suddenly racks uplosses as quickly as his old Suns teams used to pile up points.

“You have to have a plan,” D’Antoni said Wednesday. “I would be veryselfish. I tell players to sacrifice all the time. If the plan is that we’ve gotto do this, then what does that tell me if I can’t do it?”

It won’t be easy though.

“If we don’t win, it’s going to be hard,” said his brother, Dan, a Knicksassistant. “You can be patient, and he understands that. But it’s hard to chokeit back. He wants to win, he thinks he can win.”

The plan Mike D’Antoni alluded to was the Knicks’ goal of being in positionto make a run at James or some other free agent next summer, when a deep classof free agents will be available. To do that, they traded away their top twoscorers, Jamal Crawford(notes) and Zach Randolph(notes), early last season to free up salarycap space, then did little to upgrade this summer, choosing to save their moneyinstead.

It was somewhat lousy timing for D’Antoni. After the Knicks threw away moneyon bad contracts for most of the decade, he arrived in time to see them becomefinancially responsible. Still, team president Donnie Walsh said his coach hasnever come to him with a request to get him better talent now.

“We talk every day and he knows,” Walsh said. “Look, we would get aplayer if the guy was somebody we knew we wanted to live with, but we’re nottaking chances. So no, he hasn’t. He understands what we’re trying to do.”

He can’t like the effect it will have on his career record. The Knicks went32-50 last season and it’s possible D’Antoni could lose 100 games in two seasonsin New York. Isiah Thomas was fired for that.

D’Antoni knew only winning in Phoenix, where he averaged 58 victories in hisfour full seasons and twice reached the Western Conference finals. He wasconsidered an offensive genius and a star in the coaching business—but ofcourse he had All-Stars like Nash and Stoudemire. Becoming a great coach ofteninvolves having great players first, and right now D’Antoni doesn’t.

“That’s amazing, isn’t it? That’s how it is. That’s how it usually works,”D’Antoni said. “But I don’t think you get into that. I’ve never been intothat.”

No player on the Knicks roster has ever been an All-Star. A coach like LarryBrown loves having players who are low on star power so he can teach them. Manycoaches would probably prefer it the other way.

“I think Mike is halfway of that,” Dan D’Antoni said. “Winning driveshim, but he loves basketball and he loves getting guys to a certain level. So Ithink he’s not quite Larry Brown, he’s probably not Pat Riley. He’s probablysomewhere in between.

“He understands we’re going to have to do a teaching job, that it’s notgoing to be instant wins, that there is going to be a stepping process. Butcertainly he thinks and we think the organization and coaches are up to thattask and that the players will buy in.”

Mike D’Antoni said the Knicks will have to overachieve this season to makethe playoffs, but he believes they can. More likely, their lack of talent willkeep them out of the postseason for the ninth straight year.

Walsh’s plan has risks. The Knicks could strike out in free agency and beright back in the same place when they open camp next fall. But D’Antoni is onboard, and he won’t rock the boat.

“This is fun, I love it. It’s a challenge and I’m with our guys, and youknow what, if we lose, we lose,” D’Antoni said. “But if we do everything we’resupposed to do and that’s what happens to us, then so be it. I’m OK with that.”

Local Knowledge: Atunyote and the Turning Stone Resort Championship (PGA.com)

September 30, 2009

With the PGA Tour Playoffs for the FedExCup in the books for 2009, the Fall Series begins this week in Verona, N.Y. at the Turning Stone Resort. The players will be challenged on the resort's Atunyote course. Five 2009 champions will be there, helping to fill out a strong field. Before the tournament tees off on Thursday morning, Turning Stone PGA Head Professional Miles Blundell took time for a little Q&A with PGA.com to talk about what is sure to be an exciting week.

PGA.com: Tell us about the excitement level up in Verona with the PGA Tour in town this week for the Turning Stone Resort Championship.

Blundell: It's incredible right now. The fall weather we have is just beautiful and the course is in absolutely unbelievable shape. After the excitement of last week with the dramatic finish to the FedExCup, we're excited to carry that momentum as the first event of the Fall Series and we know we have a great field. We were lucky enough to have Tiger here about a month and a half ago for an event hosted by Notah Begay and I think that created a lot of buzz amongst the players on Tour.

PGA.com: Atunyote is such a beautiful course to look at. It's just one that really catches your eye and leaves an impression. Can you tell our readers a little about what makes Atunyote so special?

Blundell: It's a beautiful place and the conditioning is second to none. From a number of rounds standpoint, we don't do a lot. In fact, last year we only did 4,200 rounds and that allows us to provide an unbelievable golf experience for our guests. The greens are always perfect, just like the rest of the course. With a lower number of rounds played we are able to provide a first-class experience. We have our caddies meet guests' right at the curb; we take them through the clubhouse and the locker room. The tee times are spaced out 15 minutes apart, which means that most of the time when you play, you feel like you're in the only group on the course.

PGA.com: From what I understand, this will be your first Turning Stone Resort Championship in your role there as Head Professional. But, you're not new to being the host professional at a Tour event. You used to work at Nemacolin, which was home to the old 84 Lumber Classic. Is there any one thing that you remember experiencing during that time at Nemacolin that you're most looking forward to experiencing again this week at Atunyote?

Blundell: The thing I'm most looking forward to is the player reaction to the facility. While Nemacolin and Turning Stone are two completely different resorts, there are also a lot of similarities since they're both first-class operations. Seeing how the players react and seeing how the facilities compare—I'm looking forward to getting that feedback from the players. Atunyote is a Fazio course, while Nemacolin was a Dye course. They're both really good. Aside from the feedback, I can't wait to experience the thrill of the leaders coming up the 18th fairway on Sunday afternoon and watching some good golf. This is a neat place.

PGA.com: With the Playoffs now over, you guys were still able to draw a strong field of players, including five guys who have won this season. Is that a testament to the course and the tournament that rather than shutting it down, these guys are up in Verona to play your event?

Blundell: I think that the buzz with the Tour players and Atunyote speaks for itself. The guys rave about the greens and the strength of field we have is outstanding. I was really surprised to see some great names in the Monday qualifier—Lee janzen among them—and guys like Tag Ridings, who I thought for sure would be automatically qualified for the event. At that Monday qualifier we had one 69 and four players that shot 70 and there was a four-way playoff for three spots. It was an exciting way to kick off the week and I know it's only going to get better.

PGA.com: This time of year it can be quite cool up north. I think I remember seeing snowflakes at Turning Stone a few years ago. What kind of weather are you anticipating and could that have a significant impact on the outcome?

Blundell: The weather forecast… I just looked and luckily we're not anticipating any showers. The temperatures won't be as warm as we might like, but that's what Fall is all about. It will be mild with some sun. I think it will play a big role in the outcome for sure, because the windbreakers will be out—especially in the mornings—and the guys will be dressing a lot warmer than they're used to.

One of the many cool things about Turning Stone is our indoor, climate-controlled golf dome. In fact, there are about a dozen or so players practicing in there right now. It's comfortable and different, which I think they like. They can practice later and not worry about getting cold… Yet.

Pearl: Negedu awaiting word on tests

September 30, 2009

KNOXVILLE, Tenn. (AP)—Tennessee forward Emmanuel Negedu’s doctors andguardians were reviewing medical tests to make decisions about his playingfuture, coach Bruce Pearl said Wednesday.

Negedu was revived by members of the Volunteers’ training staff after apost-workout collapse at the Tennessee training facilities on Monday. Tennesseestaff have not confirmed reports that the 20-year-old did not have a pulse aftercollapsing.

Pearl said doctors are reviewing whether the 6-foot-7, 218-pound sophomorefrom Kaduna, Nigeria, has hypertrophic cardiomyopathy, a condition blamed forthe sudden death of more than a hundred athletes each year.

Negedu was expected to remain at the University of Tennessee Medical Centerfor a third night, the coach said.

“I would ask that folks continue to pray for him as he is in no immediatecause for concern right now in the hospital, but obviously decisions are beingmade about his future,” Pearl said in a brief statement without takingquestions. “We would just ask that folks please stop speculating about what mayor may not happen.”

Negedu’s U.S. guardians, Frank and Alison Quirk, were in Knoxville onWednesday to be with Negedu and help make decisions about his future. The Quirkswere Negedu’s host family while he attended Brewster Academy in Wolfeboro, N.H.

“When they get through all the tests and they make their analysis, thendecisions will be made about what is going to happen with Emmanuel immediatelyand what is going to happen with his future,” Pearl said.

As a freshman, Negedu played in 33 games, averaging 7.2 minutes, 1.9rebounds and 1.7 points per game.
